{"id":2008,"date":"2025-11-24T10:02:37","date_gmt":"2025-11-23T23:02:37","guid":{"rendered":"https:\/\/nepf.org.au\/?p=2008"},"modified":"2025-12-04T12:10:45","modified_gmt":"2025-12-04T01:10:45","slug":"from-ceasefire-to-compliance-assessing-australias-policy-options-on-gaza","status":"publish","type":"post","link":"https:\/\/nepf.org.au\/index.php\/from-ceasefire-to-compliance-assessing-australias-policy-options-on-gaza\/","title":{"rendered":"From Ceasefire to Compliance: Assessing Australia\u2019s Policy Options on Gaza"},"content":{"rendered":"\n<p>While many Western leaders, including Australia\u2019s Prime Minister Anthony Albanese, initially <a href=\"https:\/\/www.pm.gov.au\/media\/statement-middle-east-peace-plan\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">welcomed the Gaza ceasefire<\/a> as a potential turning point, hopes of lasting peace in Gaza have been dashed as Israel continues to violate Donald Trump\u2019s <a href=\"https:\/\/www.bbc.com\/news\/articles\/c70155nked7o\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">20-point<\/a> peace plan. The IDF is still bombing Gaza, killing over <a href=\"https:\/\/x.com\/QudsNen\/status\/1984899125175894391\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">200 Palestinians<\/a> in airstrikes and drone attacks since the ceasefire came into effect on 10 October 2025. Israeli human rights group B\u2019TSelem also reports Israel\u2019s deliberate policy of starvation in Gaza continues, denying the entry of approximately <a href=\"https:\/\/x.com\/btselem\/status\/1987887811970642127\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">75 per cent<\/a> of aid trucks trying to enter the enclave, despite promising to allow in 600 trucks per day. UNICEF also <a href=\"https:\/\/x.com\/michellenichols\/status\/1988248380607254805?s=20\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">reports<\/a> Israel is blocking the entry of essential items like syringes for vaccinations and baby formula.<\/p>\n\n\n\n<p>Israel\u2019s actions raise important questions about the efficacy of the peace plan and the ability of international partners to enforce compliance in the face of persistence airstrikes and continuing aid obstruction, but it also calls for a reassessment of how states such as Australia can exert diplomatic and economic pressure to ensure adherence to international humanitarian law.<\/p>\n\n\n\n<p>One proposed approach for strengthening accountability would involve Australia adopting targeted sanctions against Israeli political and military leaders until the peace plan\u2019s provisions &#8211; particularly the withdrawal from Gaza and the facilitation of humanitarian access &#8211; are fulfilled. This policy would mirror Australia\u2019s existing <a href=\"https:\/\/www.dfat.gov.au\/international-relations\/security\/sanctions\/sanctions-regimes\/ukraine-sanctions-framework\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">sanctions framework<\/a> for Russia following its 2022 invasion of Ukraine, which combined asset freezes and travel bans to increase diplomatic pressure on specific officials. <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/sep\/18\/albanese-urged-to-end-double-standard-on-israel-after-un-commission-finds-genocide-occurring-in-gaza\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Analysts<\/a> suggest that similar measures, if applied to Israel, could signal Australia\u2019s commitment to upholding consistent international standards.<\/p>\n\n\n\n<p>Another possible measure concerns defence cooperation. Australia currently maintains limited but significant links with Israel\u2019s defence industry, including procurement relationships with companies such as <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/oct\/25\/australia-20m-weapon-deal-israels-largest-arms-company-signed-two-weeks-before-un-genocide\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Elbit Systems<\/a>. Restricting arms exports or suspending defence contracts could reduce Australia\u2019s indirect involvement in the conflict and align with precedents set by European states such as Spain, which recently imposed a <a href=\"https:\/\/www.aljazeera.com\/news\/2025\/10\/8\/spains-parliament-formally-approves-israel-arms-embargo\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">permanent ban<\/a> on weapons sales to Israel. The Spanish government is now investigating company <a href=\"https:\/\/uk.finance.yahoo.com\/news\/spain-probes-steelmaker-alleged-trading-140426874.html\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Sidenor<\/a> for complicity in crimes against humanity and genocide in Gaza; an act of accountability Australia could mimic.<\/p>\n\n\n\n<p>Finally, policy experts note that any sanctions or restrictions should form part of a broader framework for legal accountability. Supporting ongoing international legal proceedings &#8211; such as South Africa\u2019s <a href=\"https:\/\/www.theguardian.com\/law\/2025\/jul\/27\/why-the-icj-is-delaying-a-gaza-genocide-verdict\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">case<\/a> at the International Court of Justice and investigations by the International Criminal Court &#8211; could strengthen global mechanisms for addressing alleged war crimes and <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/09\/israel-has-committed-genocide-gaza-strip-un-commission-finds\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">crimes against humanity.<\/a> For Australia, active participation in these processes would reaffirm its commitment to the international rule of law and its obligations under the Rome Statute.<\/p>\n\n\n\n<p>Further to this, the Australian government has an opportunity to offer its full support for the International Criminal Court\u2019s <a href=\"https:\/\/www.icc-cpi.int\/defendant\/netanyahu\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">investigation<\/a> into Netanyahu and former defence minister Yoav Gallant, including calling for further warrants to be issued for Israeli politicians and military personnel. While Netanyahu is unlikely to visit anytime soon, Albanese should also make it clear that he would be arrested on Australian soil, something Canada\u2019s Prime Minister <a href=\"https:\/\/www.news.com.au\/world\/canadian-prime-minister-threatens-he-will-detain-benjamin-netanyahu-if-israeli-leader-visits\/news-story\/46289e55dea73f214b08b4613c026839\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Mark Carney<\/a> committed to recently. This approach would be consistent with Australia\u2019s vow to arrest <a href=\"https:\/\/www.foreignminister.gov.au\/minister\/penny-wong\/media-release\/two-years-australia-stands-ukraine\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Vladimir Putin<\/a>, and its legal obligation as a signatory to the Rome Statute and member of the ICC.<\/p>\n\n\n\n<p>Closer to home, the Australian Federal Police needs to monitor, investigate and prosecute Australian\u2019s known to be <a href=\"https:\/\/www.sbs.com.au\/news\/article\/how-many-australians-are-fighting-with-israels-military-in-gaza-this-group-is-monitoring\/kcx7xr842\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">serving in the IDF<\/a>, and any Israeli citizens visiting on tourist visas who are suspected of committing war crimes and crimes against humanity in Gaza. This is an approach consistent with both international and Australian domestic law and recommended by Australian UN expert <a href=\"https:\/\/www.facebook.com\/reel\/1449710402767315\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Chris Sidoti<\/a>. It would be similar to prosecuting Australian foreign fighters who joined groups like <a href=\"https:\/\/www.theguardian.com\/world\/2025\/feb\/24\/government-should-repatriate-and-investigate-alleged-crimes-of-australian-member-of-islamic-state-experts-say-ntwnfb\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Islamic State<\/a> in Iraq or Syria, and would help ensure community safety and send a strong message of accountability to Israel.<\/p>\n\n\n\n<p>These are not extreme measures, they are actionable steps consistent with international law and similar to efforts by Australian to hold perpetrators in Russia, <a href=\"https:\/\/www.dfat.gov.au\/international-relations\/security\/sanctions\/sanctions-regimes\/myanmar-sanctions-framework\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Myanmar<\/a> and elsewhere accountable for atrocities again civilians. It should not be controversial to hold Israel to the same standard for what <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2024\/12\/amnesty-international-concludes-israel-is-committing-genocide-against-palestinians-in-gaza\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Amnesty International<\/a> calls the \u201cmost documented genocide in history\u201d in Gaza and its decades-long occupation in the West Bank.<\/p>\n\n\n\n<p>History tells us oppression and violence stops when the perpetrators are held accountable, and when there is justice for the victims. Israel-Palestine is no different. It is past time for Australia and others to end Israel\u2019s impunity.
